1. Who we are

ClearSpiral (“the App”, “we”, “us”, “our”) is an iOS wellness application operated by PointerApps. By downloading, installing, or using the App, you agree to these Terms of Service. If you do not agree, please do not use the App.

2. What ClearSpiral is — and isn't

ClearSpiral is a wellness and self-reflection tool. It is not a medical device, diagnostic tool, or substitute for professional mental-health care. The App does not diagnose, treat, cure, or prevent any condition. You should not rely on the App for medical advice, and you should always consult a qualified professional for health concerns.

3. Eligibility

You must be at least 16 years old to use the App. If you are under the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf.

4. Your account

• You are responsible for the security of your login credentials.
• You agree to provide accurate information and to keep it up to date.
• You may delete your account at any time from the App or by emailing [email protected].

5. Subscriptions & payments

ClearSpiral offers optional paid subscriptions ("Plus") for additional features. Subscriptions are sold and managed through Apple. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions from your iPhone Settings under your Apple ID → Subscriptions.

Prices are shown in the App and may vary by region. Refunds for purchases made through the App Store are handled by Apple in accordance with their policies.

6. Acceptable use

You agree not to:

• Use the App in any unlawful, harmful, or fraudulent way
• Attempt to reverse-engineer, decompile, or tamper with the App
• Use the App to harass, abuse, or harm another person
• Interfere with the operation or security of the App, our servers, or other users

7. Your content

You retain ownership of the thoughts, reflections, and other content you write or record in the App ("Your Content"). By using the App, you grant us a limited licence to store and process Your Content strictly for the purpose of providing the App to you — for example, to generate responses in a session, update your Pattern Map, or sync your data between your devices. We do not sell Your Content and we do not use it to train public AI models.

8. AI-generated responses

Some features use artificial intelligence to generate responses in real time. AI responses can be inaccurate, incomplete, or occasionally feel off — please treat them as suggestions, not instructions. Do not rely on AI output for medical, legal, financial, or other professional advice.

9. Intellectual property

The App, its design, branding, artwork, audio, code, and content (other than Your Content) are owned by PointerApps or its licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from the App without our written permission.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any content or results will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, PointerApps and its affiliates, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US $50.

12. Changes to the App or these Terms

We may update the App, these Terms, or our pricing from time to time. We will give reasonable notice of material changes. Continuing to use the App after changes become effective means you accept them.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the App.

14. Governing law

These Terms are governed by the laws applicable to PointerApps' principal place of business, without regard to its conflict-of-laws rules, unless local consumer-protection laws require otherwise.

15. Apple-specific terms

These Terms are between you and PointerApps — not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
